1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the IOTcontrol platform (“Service”), operated by IOTcontrol (“Company,” “we,” or “us”). By creating an account or accessing the Service you agree to be bound by these Terms. If you are accepting on behalf of a company or other legal entity, you represent that you have authority to bind that entity.

2. Description of Service

IOTcontrol is a cloud-based telemetry and remote-control platform designed for industrial natural-gas compressor equipment. The Service collects real-time sensor data from field units equipped with Sierra Wireless RV50 and RV55 cellular modems, displays that data on a web-based dashboard, and allows authorized users to issue remote commands to those units (e.g., engine start, engine stop, fault clear, AUX control).

The Service is intended exclusively for trained personnel operating within lawful industrial contexts. It is not a consumer product.

3. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials. You must immediately notify us at support@iotcontrol.app if you suspect unauthorized access.
  • You are responsible for all activity that occurs under your account, whether or not you authorized it.
  • Each individual user must have their own account. Sharing credentials between multiple people is prohibited.
  • You must provide accurate information when registering and keep that information current.
  • Accounts are non-transferable without written consent from the Company.

4. Acceptable Use

You agree not to use the Service to:

  • Issue remote commands to units you are not expressly authorized to control under your assigned role.
  • Manipulate or suppress alarm notifications in ways that could mask hazardous conditions.
  • Attempt to bypass, defeat, or circumvent the role-based access controls or permission checks enforced by the platform.
  • Automate command dispatch outside of officially supported integrations without prior written approval.
  • Probe, scan, or test the vulnerability of any part of the infrastructure without express written permission.
  • Use the Service for any purpose that violates applicable federal, state, or local law, including but not limited to pipeline safety regulations and OSHA standards.

5. Remote Control Safety Disclaimer

IMPORTANT — PLEASE READ CAREFULLY.

The remote control features of the Service interact with physical industrial equipment in real-world environments. Issuing commands such as ENGINE START, ENGINE STOP, FAULT CLEAR, or AUX control can have immediate physical consequences including, but not limited to, equipment movement, pressure changes, gas flow alterations, and potential personnel hazards.

You assume full responsibility for verifying that it is safe to issue any remote command before doing so. This includes, without limitation:

  • Confirming no personnel are in the immediate vicinity of the equipment.
  • Verifying current operating conditions via telemetry before commanding a state change.
  • Complying with all applicable lock-out/tag-out (LOTO) procedures.
  • Adhering to your organization’s operational and safety protocols.

The Company provides the remote control feature as a convenience tool. We do not and cannot verify field conditions remotely. The Company is not liable for any personal injury, property damage, environmental harm, or operational loss arising from remote commands issued through the Service.

6. Service Availability

The Service is provided on a commercially reasonable basis. We make no uptime guarantee or Service Level Agreement (SLA) in this version of the platform. Scheduled maintenance windows will be communicated in advance where reasonably possible.

We reserve the right to suspend or terminate access to the Service at any time for maintenance, security, legal, or operational reasons, without prior notice in emergency situations.

7. Data Retention

Telemetry data collected from field units is stored in a hot database tier for 90 days from the date of collection. After 90 days, telemetry records are archived to long-term cold storage (Amazon S3) and removed from the active query tier.

Account data, audit logs, and command history are retained for the lifetime of your account and for a minimum of 12 months after account termination, or longer if required by applicable law.

You may request deletion of personal data associated with your account by contacting support@iotcontrol.app. Deletion of operational or audit records may be subject to legal retention obligations.

8. Intellectual Property

The Service and all content, features, and functionality — including software, text, displays, images, and design — are owned by the Company or its licensors and are protected by United States and international intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works without express written permission.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, LOSS OF DATA, EQUIPMENT DAMAGE, PERSONAL INJURY, OR BUSINESS INTERRUPTION — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE COMPANY’S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO THE COMPANY IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS (USD $100).

10. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the Service, including any commands issued through the remote control features.

11. Termination

Either party may terminate your account at any time. You may terminate by contacting support@iotcontrol.app and requesting account closure. We may terminate or suspend access immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination — including limitations of liability, indemnification, and governing law — will survive.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email to the address on file or via a notice within the Service at least 14 days before taking effect. Continued use of the Service after the effective date of any change constitutes your acceptance of the new Terms.

13. Governing Law and Dispute Resolution

These Terms and any dispute arising out of them are governed by the laws of the State of Texas, United States of America, without regard to conflict-of-law principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Texas, and you consent to personal jurisdiction in those courts.
